Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of fu·do mobile apps, websites, and related services (the "Service"). By using the Service, you agree to these Terms.

Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with the consent of a parent or legal guardian. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Your account

  • You are responsible for maintaining the confidentiality of your account credentials and for activity under your account.
  • Provide accurate account information and keep it up to date.
  • Notify us promptly if you believe your account has been compromised.
  • You may delete your account in the Service where this feature is available. Deleting the app from your device does not automatically delete your account or cancel any subscription.

Your content

You retain ownership of content you submit to the Service, such as coffee logs, tasting notes, ratings, brew details, photos, check-ins, reviews, profile information, comments, and other materials ("User Content").

You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, publish, distribute, adapt, and otherwise use your User Content solely to operate, provide, secure, moderate, personalize, and improve the Service, including making content visible to other users according to your settings and the features you use.

You are responsible for your User Content and must have all rights needed to submit it. Do not upload content that is unlawful, infringing, harassing, hateful, misleading, invasive of privacy, sexually explicit, exploitative, spammy, fraudulent, harmful, or otherwise objectionable.

Community features and moderation

The Service may include social or community features, including profiles, friends, public logs, reviews, comments, forum posts, likes, saved places, or other user-visible interactions. Your activity may be visible to other users depending on your settings and the feature you use.

We may review, remove, hide, limit distribution of, refuse to publish, or preserve User Content if we believe it violates these Terms, may harm users or the Service, or may create legal or security risk. We may also suspend or terminate accounts that violate these Terms or abuse the Service.

Where available, you may adjust privacy and visibility settings. We do not guarantee that all objectionable content will be identified or removed.

Acceptable use

You agree not to:

  • Use the Service in violation of applicable law or third-party rights.
  • Attempt to access accounts, systems, or data without authorization.
  • Interfere with or disrupt the Service, including by scraping, crawling, reverse engineering, bypassing technical limits, or overloading our infrastructure.
  • Use the Service to send spam, malware, phishing, scams, or abusive communications.
  • Misrepresent your identity, affiliation, location, or the source of content.
  • Use automated systems to extract, copy, or build datasets from the Service except with our prior written permission or as allowed by law.

Subscriptions and purchases

  • Premium features may require a paid subscription or purchase processed by Apple App Store, Google Play, or another payment provider.
  • Billing, renewal, cancellation, and refunds are handled by the applicable app store or payment provider under its terms and policies.
  • Subscription pricing and included features may change with notice where required by the app store, payment provider, or law.
  • Deleting your account, deleting the app, or stopping use of the Service does not automatically cancel an app-store subscription. You must cancel through the applicable app store or payment provider.

Reference content, maps, and tools

Educational content, calculators, flavor tools, coffee information, venue listings, maps, product information, and directory data are provided for general reference only. They may be user-submitted, sourced from third parties, incomplete, outdated, or inaccurate. They are not professional, medical, nutritional, safety, or purchasing advice. Use your own judgment when making brewing, purchasing, travel, food, health, or safety-related decisions.

AI, OCR, and experimental features

The Service may include image recognition, optical character recognition, artificial intelligence, recommendations, summaries, or other experimental features. These features may be inaccurate, incomplete, or inappropriate. You are responsible for reviewing outputs before relying on them.

Third-party services and links

The Service may link to or integrate third-party services, maps, catalogs, app stores, payment providers, analytics tools, error-reporting tools, authentication providers, AI providers, hosting providers, or storefronts. We are not responsible for third-party content, policies, availability, or practices.

Changes to the Service

We may add, change, suspend, or discontinue features or the Service at any time, including free or premium features, subject to applicable law and app-store requirements.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ACCURATE, RELIABLE, SECURE, UNINTERRUPTED, OR ERROR-FREE.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR USD $100.

Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold us harmless from claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from your User Content, your use of the Service, or your violation of these Terms or third-party rights.

Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, create risk for us or other users, or if necessary to protect, maintain, or discontinue the Service. Sections that by their nature should survive termination will survive, including ownership, content licenses already granted, disclaimers, limitations of liability, indemnity, and dispute terms.

Governing law and disputes

These Terms are governed by the laws of California, United States, without regard to conflict-of-law rules, except where local consumer law requires otherwise. You and we agree to bring disputes only in the courts located in San Francisco County, California, United States, except where applicable law gives you the right to bring claims elsewhere.

Changes

We may update these Terms from time to time. We will post the revised Terms and update the effective date above. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms, except where law requires a different process.
